Robert Hanna and Elizabeth his wife to Robert Allender

This indenture made this first day July in the year of our Lord one thousand eight hundred and thirty nine by and between Robert Hanna and Elizabeth his wife of the County of Belmont in the state of Ohio of the one part once Robert Allender of the County and Sate aforesaid of the other part witnesseth that Robert Hanna and Elizabeth his wife for and in consideration of the just sum of one hundred and sixty dollars to them in hand paid the receipt of which they do hereby acknowledge have given granted bargained sold released and conveyed and by these present to give grant sell bargain release convey and confirm unto the said Robert Allender and his heirs and assigns forever all that tract parcel of land situated and being in the County of Belmont in the State of Ohio aforesaid being a part of the tract this day convey to the said Robert Hanna by said Robert Allender and wife and _____as follows beginning at the North east corner of said tract on the west shore of the Ohio River at a small white walnut tree six inches in diameter leaning hollow and marked A. H having an Elm tree 10 inches in diameter bearing from it near SW distant six feet marked A H thence with the north boundary line of said tract west eighty poles thence at right angle with said line South eight poles thence by a line parallel with the aforesaid north boundary line East to the West shore of the Ohio river thence with the said shore of the Ohio river to the place of of beginning containing four acres neither more nor less. To have and to hold the premises aforesaid with all the privileges and appurtenances thereunto belonging or in any wise appertaining the fences excepted unto him the said Robert Allender and unto his heirs and assigns forever. And the said Robert Hanna and Elizabeth his wife for themselves and for their heirs executors and administrators covenant and promise to and with the said Robert Allender his heirs and assigns that they Robert Hanna and Elizabeth his wife are lawfully seized of the premises aforesaid that they have good right and lawful authority to sell and convey the same. And further that day the said Robert Hanna and Elizabeth his wife will and truly warrant and forever defend the premises herein and herby granted unto the said Robert Allender and to his heirs and assigns against the lawful claims of all and every persons whomsoever. In testimony whereof the said Robert Hanna and Elizabeth his wife party of the first part have hereunto set their hands and seals the day and year first above written.

On the 9th day of July 1839 before me the subscriber a justice of the peace within and for said County personally appeared the said Robert Hanna and Elizabeth Hanna who signed and sealed the foregoing deed and acknowledged the signing and sealing thereof to be their act and deed for the purposes therein expressed and the said Elizabeth Hanna wife of the said Robert Hanna being by me examined separate and apart from her said husband and the contents of said deed being freely made known to her by reading the same in her presence she did declare upon such separate examination that she did voluntarily sign seal and deliver and acknowledge the same and that she is still satisfied therewith M L Todd a Justice of the Peace in and for said county
